Changwon Rehabilitation

Residents of Changwon, Masan, Jinhae and Gimhae file for individual rehabilitation with the Changwon District Court main court, and anyone with an address in Gyeongsangnam-do may also file with the Busan Bankruptcy Court. Our Changwon Office is a 2-minute walk from the court's main gate; call 055-715-3119.
Residents of Changwon, Masan, Jinhae and Gimhae file with the Changwon District Court main court, and with an address in Gyeongsangnam-do you can also file with the Busan Bankruptcy Court. Masan residents also file with the main court, not the branch.
We pick the court based on which is easier to reach for the creditors' meeting. If a wage garnishment is imminent, talk to us before all the documents are gathered. Attorney Lim Jae Hyun, who holds a specialization in Insolvency registered with the Korean Bar Association (KBA), handles these cases.

ATTORNEY
You file with the Changwon District Court main court, not a branch. Individual rehabilitation cases fall under the exclusive jurisdiction of the rehabilitation court for the debtor's address (Debtor Rehabilitation and Bankruptcy Act, Article 3(1)), and the branches in Gyeongnam do not handle them. With an address in Gyeongsangnam-do you can also file with the Busan Bankruptcy Court (Article 3(11)), so you choose whichever of the two is easier to attend.
Yes. Whether you file at Changwon District Court or the Busan Bankruptcy Court, stay and prohibition orders are issued under the same provision (Debtor Rehabilitation and Bankruptcy Act, Article 593(1)), so compulsory execution and demands for payment can be halted until the commencement decision. The order takes effect only when the court finds it necessary and issues it, so the petition also states that garnishment is imminent.
Not automatically. Jurisdiction is set by your address or workplace at the time of filing, and the court may transfer the case ex officio to the rehabilitation court for your new address only when it finds this necessary to avoid significant harm or delay (Debtor Rehabilitation and Bankruptcy Act, Article 4). After moving, notify the court of the address change and recheck the creditors' meeting date.
Yes. The court handling the case sets and presides over the creditors' meeting (Debtor Rehabilitation and Bankruptcy Act, Article 613(1) and (3)), so if you file with the Busan Bankruptcy Court, the meeting is held in Busan, and the debtor must attend and explain the repayment plan if a creditor asks (the same Article, paragraph 2). For places close to Busan such as Gimhae and Yangsan, filing in Busan is often easier to attend, and for western Gyeongnam such as Jinju and Geoje, the Changwon main court often is.
You deposit it with the rehabilitation commissioner. The debtor entrusts the repayment money to the rehabilitation commissioner under the approved repayment plan, and the commissioner pays the creditors according to the plan (Debtor Rehabilitation and Bankruptcy Act, Article 617(1) and (2)). You do not pay creditors directly, so after approval the Changwon Office tells you the deposit account and payment date, and asks you to let us know in advance if a payment may be late.
