What do I check first when choosing a lawyer in Changwon?
Check five things in this order: which court will hear the case, who will attend that court's hearings, what specialization that lawyer has registered with the Korean Bar Association (KBA), whether the first consultation is held directly with the lawyer, and whether the scope of the engagement is written in the contract. Even within Changwon City, jurisdiction is split between the main court and the Masan Branch depending on the district. Across Gyeongnam as a whole, branches are spread out to Jinju, Tongyeong, Miryang and Geochang, so an office address in Changwon alone does not tell you whether it suits your case.
| Check | Why it matters | How to check |
|---|---|---|
| Competent court | The main court and the branches are divided by address and type of case, and travel distance and schedules differ by court | Search by address in Find the competent court on the Supreme Court of Korea website |
| Lawyer who attends | In a firm with offices in several regions, the office where you consulted and the office where the lawyer in charge works may differ | Ask for the name of the lawyer in charge written in the contract and who will attend the hearings |
| Registered specialization | Whether "specialist" in an advertisement means KBA registration can only be known by checking | Search by real name in the lawyer search on the KBA website |
| Consultation format | The lawyer who will handle the case should hear the facts directly | When booking, ask who will hold the first consultation |
| Written contract | Disputes arise easily when the stages covered and the fee terms are agreed only orally | Check that the scope and terms are written in the contract |
Which part of the Changwon District Court will hear my case?
The Changwon District Court consists of the main court (681 Changi-daero, Seongsan-gu, Changwon) and five branches. The jurisdictional areas published on the Changwon District Court website are as follows.
| Court | Jurisdictional area |
|---|---|
| Changwon District Court, main court | Seongsan-gu, Uichang-gu and Jinhae-gu in Changwon; Gimhae-si |
| Masan Branch | Masanhappo-gu and Masanhoewon-gu in Changwon; Haman-gun; Uiryeong-gun |
| Jinju Branch | Jinju-si, Sacheon-si, Hadong-gun, Namhae-gun, Sancheong-gun |
| Tongyeong Branch | Tongyeong-si, Geoje-si, Goseong-gun |
| Miryang Branch | Miryang-si, Changnyeong-gun |
| Geochang Branch | Geochang-gun, Hapcheon-gun, Hamyang-gun |
The actual jurisdiction can vary with the type of case. Criminal cases are based on the place of the crime and the defendant's address (Criminal Procedure Act, Article 4), and divorce lawsuits are based on the spouses' addresses (Family Litigation Act, Article 22). According to the guide to courts on the Supreme Court of Korea website, Busan and Ulsan have family courts but Gyeongnam has no separate family court, so family cases in Changwon are handled by the Changwon District Court and its branches. Individual rehabilitation is filed with the Changwon District Court, and a debtor with an address in Gyeongnam may also file with the Busan Bankruptcy Court (Debtor Rehabilitation and Bankruptcy Act, Article 3(11)).
Questions to ask at the consultation
- Will my case be heard at the main court or at a branch?
- Who will consult with me in Changwon and attend the hearings?
- What specialization has that lawyer registered with the KBA?
- How can I contact the lawyer in charge directly?
- How will documents be exchanged if I travel from Masan, Jinhae or Gimhae?
- Will the contract set out both the scope of the case and the fee terms?
Warning signs to avoid
Article 4 of the KBA Regulations on Attorney Advertising prohibits advertising that implies influence by pointing to connections with public officials engaged in trials or investigations, and advertising that uses names other than the principal office and branch offices defined by the Attorney-at-Law Act. In areas where law offices cluster in front of the court, watch especially for the signs below.
- Urging you to hire them by saying they know someone at the court or an investigative agency
- Promising an outcome or putting forward the percentage of cases won as a number
- Signing a contract with staff without ever meeting a lawyer
- Avoiding the question when you ask about the type of office and its lawyers
- Trying to settle the fee terms orally, without anything in writing
If cost is a concern, call the Korea Legal Aid Corporation at 132 (no area code) to check whether you qualify for legal aid.
